Commerce committee votes 18–5 to boost penalties, define daily fantasy sports

WASHINGTON, Feb 20: The Florida House of Representatives Commerce Committee has voted 18–5 to advance House Bill 189 (HB 189), a sweeping proposal aimed at cracking down on illegal slot-style gambling operations while formally defining and regulating daily fantasy sports (DFS) in the state.

The legislation, cleared by the committee on February 10, 2026, seeks to tighten enforcement against so-called “adult arcades” and internet cafés that lawmakers say have flourished under relatively light penalties. HB 189 would elevate several illegal gambling offences from misdemeanours to third-degree felonies in an effort to deter repeat violations.

Supporters argue that existing fines are often treated as a cost of doing business. Representative Trabulsy said the state requires “teeth” to stop illegal gambling rooms from reopening, adding that stronger criminal provisions are necessary to break alleged financial links between such establishments and organised crime.

However, some critics have voiced concern that the broader felony provisions could inadvertently affect low-level employees who may not be aware they are working in violation of gambling laws.

The measure is also designed to protect the state’s 2021 gaming compact with the Seminole Tribe of Florida, under which the Tribe agreed to pay USD 2.5 billion over five years to the state. Lawmakers contend that illegal slot-style venues undermine the Tribe’s exclusive rights and deprive Florida of revenue.

Beyond enforcement, HB 189 provides long-awaited clarity for the daily fantasy sports industry. The bill defines DFS as paid-entry contests in which participants manage simulation teams, while drawing “a hard line” to prevent such contests from evolving into traditional sports betting.

Under the proposal, contest results cannot be based on point spreads or final team scores, cannot hinge on a single athlete’s performance in one event, and cannot involve juvenile, collegiate or high school sports. The framework would allow companies such as DraftKings and FanDuel to operate within clearly defined limits, while preserving the Seminole Tribe’s exclusive right to sports betting in Florida.

The bill also introduces ethics reforms for the Florida Gaming Control Commission, including provisions barring individuals with direct gambling ties from serving on the commission and restricting former commissioners from immediately transitioning into lobbying roles.

Additionally, it restores some authority to local governments to enact their own gaming rules and creates a certification pathway for charitable “amusement games” at veterans’ organisations.

The legislation now heads to the Florida House floor. With the 2026 session underway, lawmakers must decide whether the need for stronger enforcement outweighs concerns about potential unintended consequences.
