Ranchi, June 13: The High Court’s division bench has dismissed an appeal filed by the Jharkhand Public Service Commission (JPSC) against a single bench order related to the appointment of an ST candidate to the post of assistant professor. The bench, led by Chief Justice M.S. Ramachandra Rao, upheld the earlier judgment and imposed a fine of ₹1 lakh on JPSC.
The case involves Manoj Kumar Kacchap, whose application was earlier rejected due to a technical error where his examination fee was not credited to JPSC’s account. He approached the High Court, where the single bench ruled in his favour.
The court noted that since the candidate had appeared for the interview on the court’s directions and scored the highest marks, he could not be excluded from the selection process. It also observed that in some exams, ST candidates are exempted from paying the fee, and such a technical issue should not deprive him of his rightful opportunity.
JPSC had challenged this decision in a division bench, which has now rejected the appeal and ordered the commission to comply with the single bench’s directive within four weeks.
