Dhanbad, Sept 1: A special MP-MLA court in Dhanbad on Tuesday deferred a decision on the anticipatory bail plea of Dumri MLA Jairam Mahto and three others in connection with an alleged altercation and obstruction of government work at Barwadda police station.
After hearing arguments from both sides, Special Judge Durgesh Chandra Awasthi directed the police to produce the case diary and fixed September 10 for the next hearing.
Mahto, along with Sushil Mandal, Mahendra Saw and Rajkumar Mandal, has sought anticipatory bail in Barwadda police station case number 146/26.
During the hearing, defence counsel Shahnawaz urged the court to restrain the police from taking any coercive action against the accused. Additional Public Prosecutor Satyendra Kumar Rai opposed the plea and requested that the case diary be placed before the court.
After considering the submissions, the court directed the police to produce the case diary and posted the matter for further hearing on September 10.
What is the case?
The case relates to an incident at the Barwadda police station on August 22. According to police, an FIR was registered on the basis of a complaint by Barwadda station in-charge Ravi Kumar against Mahto, Mandal and others.
Police have alleged that Mahto and his supporters misbehaved with police officials at the station premises and obstructed government work. The police have also alleged that supporters created a commotion at the station and that Mahto called for Ganesh Das, who was allegedly lodged in the police lock-up, to be brought out.
Based on these allegations, the police registered a case under provisions relating to obstruction of government work, alleged misconduct with police officials and other offences.
The allegations contained in the FIR are yet to be established before a court.
Mahto and the other accused had initially filed their anticipatory bail plea before the Principal District and Sessions Judge’s court. The petition was transferred to the MP-MLA court on Monday for hearing.
The next hearing in the matter is scheduled for September 10.
