New Delhi, Aug 7 : The Delhi government on Friday tabled the Delhi School Education (Removal of Difficulties) Order, 2026 in the Legislative Assembly, seeking to set clear timelines for the constitution of school-level fee regulation committees and prevent arbitrary fee hikes.
Education Minister Ashish Sood said the measure was aimed at ensuring that fee regulation committees are constituted on time and that schools do not impose excessive charges on parents and students.
The order has been introduced under Section 21 of the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, which allows the government to address difficulties arising in implementing the legislation.
The government said the provision was necessary because the Act came into effect only on December 10, 2025, while it required School-Level Fee Regulation Committees (SLFRCs) to be constituted by July 15 for the 2025-26 academic year.
Under the proposed timelines, private schools will have 10 days from publication of the order in the Delhi Gazette to constitute SLFRCs for the three-year fee cycle beginning 2026-27. Schools will then have 14 days to submit their proposed fee structures for the next three academic years.
The committees will subsequently determine fees in accordance with the provisions of the Act.
SLFRCs already constituted under the December 24, 2025 order will continue to remain valid.
The order also directs the Directorate of Education to constitute District Fee Appellate Committees (DFACs) for each education district within 30 days.
No fresh fee hike during transition
A key provision of the order states that schools cannot charge fees above the amount already being collected from April 1, 2025, until the fee structure for the next three-year cycle is formally approved.
This effectively bars fresh fee increases during the transition period.
The government also said allegations of excessive fees charged during 2025-26 would be examined and regulated, subject to the outcome of legal proceedings challenging the Act before the Delhi High Court and the Supreme Court.
The order further provides that once a three-year fee cycle ends, schools cannot increase fees beyond the amount fixed for the final year of the previous cycle until the next fee structure is approved.
The government has warned that schools or authorities failing to comply with the prescribed timelines could face administrative and regulatory action under the Act and its rules.
